TERMS AND CONDITIONS
TERMS AND CONDITIONS OF THE ONLINE STORE Skin Minimalism Sp. z o.o.
§ 1. General provisions
1. These Terms and Conditions constitute regulations for providing electronic services, as specified in Article 8(1) of the Act of July 18, 2002, on the provision of electronic services.
2. Seller — Service Provider is Skin Minimalism Sp. z o.o. with its registered office in Warsaw, ul. Adama Branickiego 12/76, 02-972 Warsaw, NIP 9512578758, REGON 526480263, KRS 0001060768, e-mail address: contact@skinminimalism.co
3. The Rules of Procedure shall specify:
- types and scope of services provided electronically within the online store available at: https://skinminimalism.co,
- conditions for concluding a contract of sale,
- terms of termination of the contract of sale,
- the right to withdraw from the contract,
-method of payment,
-costs, methods and terms of delivery of products,
-procedure for complaint and warranty proceedings,
- extrajudicial means of resolving complaints and pursuing claims.
§ 2. Definitions
1. The seller-service provider — Skinminimalism Limited Liability Company.
2. Client-service-recipient — a natural or legal person using services in the online store www.skinminimalism.pl.
3. Consumer — a customer who is a consumer within the meaning of Article 22 (2) of the Civil Code.
4. Entrepreneur — a customer who is an entrepreneur within the meaning of Article 43 (1) of the Civil Code.
5. Account — an electronic service with an individual login and password of the Client.
6. Terms and Conditions — this document.
7. Commodity/Product — products offered for sale in the online store www.skinminimalism.pl.
8. Sales Agreement — a contract for the sale of Goods within the meaning of Article 535 of the Civil Code, concluded between the Seller and the Customer.
9. Services — services provided electronically by the Seller.
10. Order — a statement of the Customer's will aimed at concluding a Sales Agreement.
§ 3. Rules of use of the online store
1. The Seller undertakes to comply with these Terms and Conditions.
2. The customer is obliged to provide data consistent with the actual situation and use the store in a manner consistent with the provisions of the law.
3. It is forbidden for Customers to provide illegal content and to use the store's services in a way that is not burdensome for other Customers and the Seller.
§ 4. Services
1. The Store allows the Customer to place orders for the products available in the offer.
2. The services provided by the Seller are free of charge and the order process can be completed at any time before finalization.
§ 5. Conditions of conclusion and withdrawal from the contract of sale
1. The customer has the right to withdraw from the sales contract without giving any reason within 14 days from the date of delivery of the product.
2. In order to withdraw from the contract, the Customer should inform the Seller by sending a statement of withdrawal to the e-mail address: collab@skinminimalism.co or by registered letter to the address of the company's registered office.
3. In case of withdrawal from the contract, the contract is considered not concluded and the Customer will receive a refund of all payments made, including the cost of delivery of the Goods, within 14 days from the date of receipt of the statement of withdrawal.
4. Refunds are made using the same payment method used by the Customer.
§ 6. Method of payment
1. The prices of the products are given in Polish zlotys and include all components, including VAT.
2. The customer can make the payment:
- transfer to the Seller's bank account,
-by means of an electronic payment system,
-cash on delivery, paying the courier upon receipt.
§ 7. Costs, methods and terms of delivery
1. The delivery of products is carried out on the territory of the Republic of Poland and the European Union.
2. Orders are processed through a courier company or the Polish Post.
3. The delivery time of the order is 2-5 business days from the date of posting the payment for the order. In the case of delivery within the European Union, the delivery time may be extended.
§ 8. Procedure for complaint procedure
1. The Customer has the opportunity to submit a complaint regarding the product or service in writing (by registered letter) to the Seller's address or by e-mail to the address: contact@skinminimalism.co.
2. The complaint should contain a description of the problem, the date of occurrence of the defect and the contact details of the Customer.
3. The seller will consider the complaint within 14 days of receiving it, and in the case of particularly complicated cases — up to 30 days. The customer will be informed about the outcome of the complaint in the form of an e-mail or by letter.
4. If the product has a manufacturer's warranty, information about this can be found in the product description in the store.
§ 9. Extrajudicial means of resolving complaints and asserting claims
1. Customer — The Consumer has the opportunity to use out-of-court ways of dealing with complaints, including:
- to apply to the provincial inspector of the Trade Inspection with a request for mediation,
-lodge a complaint via the EU ODR platform: https://ec.europa.eu/consumers/odr.
§ 10. Protection of personal data
1. Customers' personal data are processed in accordance with applicable law and privacy policy available on the Seller's website.
2. The Seller applies appropriate technical and organizational measures to ensure the security of personal data processed in connection with the execution of orders.
§ 11. Final provisions
1. In matters not regulated in these Regulations, the provisions of the Civil Code and the Consumer Rights Act apply.
2. The Seller reserves the right to change the content of the Terms and Conditions for legitimate reasons, e.g. change of legal regulations or the offer of the store.
3. Any disputes related to the activities of the online store shall be resolved by the court competent for the Seller's registered office.
